Order

These terms (Terms) apply to the ordering, purchase and delivery of Goods
from the Website and form a contract between you and NJA A.Serwinska (NJA), registered
in Poland, NIP number 5831792578, Wrzosowa 38 street, 84-208 Kielno, POLAND.

1. Definitions

Business Day means a working week day according to the Polish law.

Delivery Address means the address to which the Goods are to be delivered, as stated on
your Order.

Delivery Agent means a third party delivery or shipping company engaged by NJA to deliver
Goods.

Delivery Fee means a fee for the delivery of Goods.

Goods means the items offered for sale on the Website.

VAT has the meaning of Value Added Tax.

Order means a request by you to purchase Goods from NJA under these Terms.

Price means the purchase price of each Good as specified on the Website.

Privacy Policy means the NJA Privacy Policy. View the NJA Privacy
Policy

Website means the site www.serwinska.pl and
all sub-sites of it.

You and Your means you as the purchaser of Goods from NJA pursuant to
these Terms.

A. Compliance with Terms

1. You will be bound by these
   Terms each time you submit an Order.
2. Each Order you place will be a
   separate contract between you and NJA for the supply of Goods.

B. Orders

1. You acknowledge that all Goods
   purchased under these Terms are intended for personal, non-commercial use only
   and will not be re-sold.
2. We reserve the right to cancel
   the Order, without being liable in any way, where the Goods cannot be expected in
   a reasonable way to be ordered for a personal use.
3. You may Order from NJA if you
   are aged 18 years or over and have an active email account at which you can be
   contacted and use web browser software to access the Website.
4. If you place consecutive or
   separate Orders, we cannot consolidate your Orders. A separate Delivery Fee, if
   applicable, will apply to each Order.
5. NJA reserves the right to
   accept or reject your Order for any reason at any time. If NJA rejects your
   Order you will receive a refund of any money paid.
6. Your Order becomes a sale when
   your Order is dispatched and NJA has issued you a Tax Invoice

C. Availability of Goods

1. We may withdraw or suspend
   from sale any Good displayed on the Website, either temporarily or permanently,
   at any time. We reserve the right to change the Price of the Good at any time. NJA
   will not be liable to you for any loss you or any third party suffer as a
   result of a withdrawal or suspension of sale or price change of a particular
   Good.
2. While we try and ensure that
   all prices on the Website are accurate, errors may occur. If we discover an
   error in the price of goods you have ordered we will inform you as soon as
   possible and give you the option of reconfirming your Order at the correct Price
   or cancelling it. If we are unable to contact You we will treat the Order as
   cancelled. If you cancel and You have already paid for the goods, You will
   receive a full refund.
3. NJA reserves the right not to
   honour any incorrect offers represented on the Website made by genuine human or
   system error.

D. Portrayal of Products

1. While every effort has been
   made to portray items accurately, slight variations may occur. All pictures and
   images of Goods displayed are for illustrative purposes only.
2. All measurements quoted are
   approximate and the reproduction of colours is as accurate as photographic and
   publishing processes will allow. Please note there may be variations in colours
   dependant on the calibration and settings of individual screens and a real colours
   you see depend on the light conditions.
3. We make reservations for any
   typing errors which may occur on the website.

E. Price and payment

1. When you place an Order, we
   will charge you and you agree to pay the Price and any applicable Delivery Fee.
2. All Prices are in Polish Zloty
   and, if VAT applies, inclusive of VAT. Any fees and charges (including Delivery
   Fees) imposed by these Terms also include VAT where applicable.
3. Payment methods are specified
   on the Website.
4. Any payment for an Order must
   be cleared by NJA before Goods are dispatched. If your payment cannot be
   processed, your Order will be rejected.

F. Delivery

1. We ship Goods only to countries
   specified on the Website.
2. We make every effort to
   deliver Goods within the estimated timescales; however delays are occasionally
   inevitable due to unforeseen factors.
3. If we do not deliver the goods
   within the estimated timescales you may call upon us to make the delivery
   within an additional period of time appropriate to the circumstances.
4. If we fail to deliver the
   goods within that additional period of time, you shall be entitled to terminate
   the contract.
5. We have the risk and liability
   for damage to the Goods during transport when delivering until you or someone
   appointed by you have taken physical possession of the goods.
6. If you choose to return the
   goods regardless of the situation you will have the risk and liability for
   damage to the goods during transport when returning until we have taken
   physical possession of the goods.

G. Order cancellations and returns

1. No cancellations or changes to
   Orders will be accepted, and the Goods will be delivered to the Delivery
   Address in an Order. You should carefully check that your Order is accurate
   before you submit it.
2. If we cannot contact you about
   your Order using the contact details you provided in the Order, after having
   made reasonable attempts to contact you, we will cancel your Order and refund
   any money paid.
3. Goods can only be returned if
   a physical damaged to them has occurred during the Delivery. No other returns
   are permitted.
4. If the original payment was
   made on a credit card, refunds will be processed on the same card as the
   original payment was made.

H. Complaints and Defective items

1. Any complaints will be handled
   in accordance with the legislation of Poland Republic.
2. If any errors or defects
   should occur with our products, you may claim remedy in accordance with
   statutory law on the sale of consumer goods. 
3. You acknowledge that all Goods
   are fully handmade painted and all complaints related to the quality of the painted
   work will be rejected. You also confirm and accept, that every single product
   is a unique work of art and differs from all other products, even if represents
   the same type of pattern used to produce other products.
4. Any claim or complaint notice
   shall be delivered to us by an email sent to address olascrafts@serwinska.pl.

I. Privacy

1. Personal Information, which
   you provide to us during the Order, including contact details, will be kept,
   used and disclosed by us in accordance with NJA’s Privacy Policy for the
   purpose of processing and delivering your Order.
2. You agree to obtain consent to
   provide NJA with Personal Information of recipients of Goods Ordered by you.
3. We may also collect (even if
   you do not register to the Website), and our third party providers of
   advertisements and content may collect, location and other information such as
   the URL or advertisement you came from or linked to, IP address, browser type,
   pages you visited from the Website etc.

J. Guarantee, Risk & Liability

1. NJA will not be liable to you
   for loss you or any third party suffers for a delay or failure to process your
   Order or deliver Goods due to inaccurate or incomplete details provided in an
   Order.
2. Risk and title in the Goods
   passes to you on the date and time of delivery of the Goods by the Delivery Agent.
3. Wo do not provide any type of
   guarantee or warranty. NJA excludes to the fullest extent possible under Law,
   all implied terms and warranties whether statutory or otherwise, relating to
   the subject matter of these Terms.
4. Our liability to you for loss
   or damage of any kind arising out of these Terms will be reduced or limited to
   the extent (if any) that you cause or contribute to the loss or damage.
5. We assume no liability other
   than what follows of statutory legislation. We cannot in any event be held
   liable for any indirect or consequential losses, including but not limited to
   loss of or damage to data through use of our web site.

K. Termination

1. We may, at our discretion,
   terminate the agreement for the supply of Goods to you:
2. for convenience, at any time,
   on giving notice to you;
3. immediately if NJA reasonably
   believes that you have breached these Terms.

L. Electronic Communications

1. When visiting Website or
   sending e-mails to NJA, you are communicating electronically with us. We
   communicate with the customers by e-mail or by posting notices on the Website.
2. For  contractual purposes
   you consent to receive electronic communications from us, and agree that all
   agreements, notices, disclosures and other electronic communications that we
   provide satisfy any legal requirement that such communications be in writing.

M. General

1. We reserve the right to make
   changes to these Terms at any time.
2. Should any part of these Terms
   be deemed unlawful and invalid and thus not enforceable, this will not affect
   the validity and enforcement of the remainder of the Terms.
3. A failure or delay by NJA to
   exercise a power or right under these Terms does not constitute as a waiver of
   that power or right, and the exercise of a power or right by NJA does not
   preclude its future exercise or the exercise of any power or right.
